(“APC”, “we”, “us”, or “our”)
Aussie Pool Covers Pty Ltd provides the warranties outlined in this document for products purchased in Australia (“Warranty” or “Warranties”). These Warranties are provided in accordance with the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth).
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Customers are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. Customers are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
The benefits provided under these Warranties are in addition to other rights and remedies available under Australian law.
Product Inspection Upon Delivery
Customers should inspect all products promptly on delivery. If any product appears damaged during transit, incorrect, or incomplete, APC should be notified as soon as reasonably possible, preferably within 48 hours of delivery, together with photographs or supporting information where applicable.
Prompt notification assists APC and freight providers in assessing and resolving freight-related issues efficiently.
Nothing in this section limits any rights available under the Australian Consumer Law.
Replacement Warranty
Aussie Pool Covers offers a full replacement warranty for a period of twelve (12) months on all solar blanket pool covers supplied for domestic residential use.
The Warranty period commences from the date of completion of the contract of sale.
This Warranty covers manufacturing or material defects only and does not cover:
- colour fading;
- normal wear and tear arising from ordinary use, environmental exposure, UV degradation, pool chemicals, or ageing of materials;
- chemical deterioration;
- misuse or improper maintenance; or
- natural characteristics of the material including minor shrinkage or expansion.
Pro-Rata Warranty
In addition to the Replacement Warranty, APC offers a Pro-Rata Warranty on selected products. Under the Pro-Rata Warranty, customers may purchase a replacement cover at a discounted price based on the remaining unused portion of the applicable warranty period.
The Pro-Rata Warranty commences from the original date of purchase.
The Pro-Rata Warranty applies to the replacement product only and does not include:
- delivery charges;
- installation costs;
- labour charges;
- removal costs; or
- any ancillary expenses.
Natural Characteristics of Solar Blanket Materials
Solar blanket pool covers are manufactured from thermal plastic materials that may naturally expand or contract depending on environmental conditions including:
- UV exposure;
- ambient temperatures;
- water temperature;
- pool chemical balance;
- evaporation;
- storage conditions; and
- general usage.
Minor dimensional shrinkage of approximately 1% to 2% over the life of the product is considered normal and is not regarded as a manufacturing defect.
Shrinkage, warping, bubbling, stretching, or dimensional changes resulting from:
- excessive heat exposure;
- improper storage;
- incorrect chemical balance; or
- failure to follow care instructions, are not covered under this Warranty.
Warranty Coverage
The Warranties cover replacement or repair of products that contain a manufacturing or material defect that is not caused by:
- normal wear and tear arising from ordinary use, environmental exposure, UV degradation, pool chemicals, or ageing of materials;
- chemical degradation;
- fading;
- misuse;
- accidental damage;
- improper storage; or
- natural characteristics of solar blanket materials.
These Warranties:
- apply only to the original purchaser;
- are not transferable; and
- do not apply to products used for commercial purposes.
Australian Consumer Law
Nothing in this Warranty excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law or any other applicable legislation which cannot be excluded or limited by law.
